The Federal Motor Carrier Safety Administration has issued an immediate emergency action drastically restricting who is eligible for a non-domiciled Commercial Learner’s Permit (CLP) or Commercial Driver’s License (CDL). This nationwide crackdown follows a federal audit that revealed states were illegally issuing commercial licenses to unqualified foreign nationals, resulting in multiple fatal crashes.
States have been ordered to immediately pause the issuance of non-domiciled CDLs and revoke all noncompliant licenses. Moving forward, the FMCSA has enacted strict new requirements for foreign nationals seeking to operate commercial vehicles.
Key Rule Changes:
Visa Requirement: Non-citizens are no longer eligible for a non-domiciled CDL unless they hold a specific, employment-based visa.
Mandatory Federal Checks: All applicants must now undergo a mandatory federal immigration status check using the SAVE system.
English Proficiency Enforcement: Any commercial driver failing to meet standard English-language proficiency requirements will be placed out-of-service immediately.
