The Federal Motor Carrier Safety Administration has issued an immediate emergency action drastically restricting who is eligible for a non-domiciled Commercial Learner’s Permit (CLP) or Commercial Driver’s License (CDL). This nationwide crackdown follows a federal audit that revealed states were illegally issuing commercial licenses to unqualified foreign nationals, resulting in multiple fatal crashes.

“Licenses to operate a massive, 80,000-pound truck are being issued to dangerous foreign drivers – often times illegally. This is a direct threat to the safety of every family on the road, and I won't stand for it.” — U.S. Transportation Secretary Sean P. Duffy.

Strict New Eligibility Rules

States have been ordered to immediately pause the issuance of non-domiciled CDLs and revoke all noncompliant licenses. Moving forward, the FMCSA has enacted strict new requirements for foreign nationals seeking to operate commercial vehicles.

 

Key Rule Changes:

  • Visa Requirement: Non-citizens are no longer eligible for a non-domiciled CDL unless they hold a specific, employment-based visa.

 
  • Mandatory Federal Checks: All applicants must now undergo a mandatory federal immigration status check using the SAVE system.

 
  • English Proficiency Enforcement: Any commercial driver failing to meet standard English-language proficiency requirements will be placed out-of-service immediately.

What Motor Carriers Need to Do

Motor carriers operating with non-domiciled drivers must act quickly to ensure their workforce is compliant under this new emergency action.

 

  1. Audit Your Fleet: Immediately review the immigration and visa status of all non-domiciled drivers on your roster.

  2. Prepare for Cancellations: States like California have been directed to immediately revoke thousands of improperly issued licenses. Prepare for abrupt driver shortages if your employees hold these noncompliant CDLs.

  3. Enforce English Standards: Ensure all drivers meet the required English-language standards before dispatching them, as roadside enforcement is aggressively targeting this requirement.
