4/15/26: FMCSA Update on DataQs Program

On April 15, 2026, the FMCSA announced a major upgrade to its DataQs program, fundamentally changing how safety record corrections are processed for American truckers. This initiative establishes strict deadlines and an independent review process for states handling requests to fix data on crashes, inspections, and violations.

Key Enhancements and Timelines

States receiving Motor Carrier Safety Assistance Program (MCSAP) funding must now adhere to new, streamlined requirements for handling Requests for Data Review (RDRs). The new mandates include:

 

  • Designated Contacts & Lookback Periods: States must appoint specific points of contact for RDRs. They are now required to review inspection requests submitted within three years and crash requests submitted within five years.

 
  • Three-Stage Independent Review Process:

    1. Initial Review: Must be completed within 21 days. Crucially, decisions cannot be made solely by the issuing officer if a correction is denied.

    2. Reconsideration: Must be issued within 21 days. This stage is conducted by independent subject matter experts not involved in the initial decision.

    3. Final Review: Must be completed within 45 days by a senior decision-maker or an independent panel, ensuring an unbiased final determination.

 

These updates parallel other recent federal efforts to ensure total data integrity across all trucking systems. For example, to combat fraudulent accounts and secure safety-sensitive records, the FMCSA recently mandated strict new identity verification procedures for the Drug and Alcohol Clearinghouse, requiring mobile authentication and facial verification to securely access the portal.
